CONCERNING
THIRD AMENDMENT OF THE DECREE OF THE MINISTER OF FINANCE
No. 111/KMK.04/2003
CONSIDERING SUDDEN CUSTOMS INSPECTION IN IMPORT AREA
THE MINISTER OF FINANCE,
Considering:
- a. Whereas the performances of Directorate General of Customs and Excise government officer in doing customs duty in import area are need to be improved, it is need to execute supervision upon customs duties implementation by Inspectorate General;
- b. Whereas based on consideration as described in paragraph a, it is need to specify regulation considering third amendment of Decree of Minister of Finance No. 111/KMK.04/2003 considering sudden customs inspection in import area;
In view of:
- 1. Law No. 10/1995 about Customs Affairs (Statute Book of Republic of Indonesia No. 75 year 1995, The Supplement to the Statute Book No. 3612);
- 2. Law No. 17/2003 considering State Financial (Statute Book of Republic of Indonesia No. 47 year 2003, The Supplement to the Statute Book No. 4287 year 2003);
- 3. Law No. 1/2004 concerning State Treasury (Statute Book of Republic of Indonesia No. 5 year 2004, The Supplement to the Statute Book No. 4355);
- 4. Government Regulation NNo. 21/1996 about Taking Action in Customs Affairs (Statute Book of Republic of Indonesia No. 36 year 1996, The Supplement to the Statute Book No. 3626);
- 5. Presidential decree No. 102/2001 concerning Status, Task, Function, Authority, Organization Structure and Work Procedure of Department as last amended by Presidential Decree No. 35/2004;
- 6. Presidential Decree No. 20/P/2005;
- 7. Decree of the Minister of Finance No. 30/KMK.05/1997 about Procedure of Taking Action in Customs Affairs;
- 8. Decree of the Minister of Finance No. 453/KMK.04/2002 regarding Customs Procedures in Import Area;
- 9. Decree of the Minister of Finance No. 111/KMK.04/2003 concerning Sudden customs inspection which has amended several times, the last with Decree of the Minister of Finance No. 575/KMK.04/2005;
- 10. Decree of the Minister of Finance No. 302/KMK.01/2004 concerning Organization and Work – Procedure of Department of Finance as last amended by Decree of the Minister of Finance No. 146/KMK.01/2004;
HAS DECIDED:

REGULATION OF MINISTER OF FINANCE No. 114/PMK.04/2006 CONCERNING THIRD AMENDMENT OF DECREE OF MINISTER OF FINANCE No. 111/KMK.04/2003 CONSIDERING SUDDEN CUSTOMS INSPECTION IN IMPORT AREA.
Article I
Some Provisions in Decree of the Minister of Finance No. 111/KMK.04/2003 concerning Sudden customs inspection as amended several times and lately with Decree of the Minister of Finance No. 575/KMK.04/2005 shall be amended as following:
1. Article 1 shall be amended, hence it become:
"Article 1
a. Sudden Customs Inspection in import area hereinafter referred to as Sudden Inspection shall be mean as random inspection to import goods, with access of information given.
b. Inspection as referred to in point a related to the truth of quantity, type, weight, condition and origin country including attention to the fittingness of customs value.
c. Inspection as referred to in point b, goods in green line, shall be done examination after the issuance of goods Discharge agreement letter, while for goods in red line shall be examined after checked by supervisor."
2. Extending the validity of Decree of Minister of Finance No. 111/KMK.04/2003 concerning Sudden Customs Inspection in Import area until 31 December 2007.
Article II
This decree shall put into effect since 1 January 2007.
For everyone to be informed, this Ministerial Decree shall be promulgated in State Gazette of the Republic of Indonesia.
